What can a landlord legally charge me before I move in, and how do I avoid a rental scam?
The most a landlord can ask for before you move in is four months’ money: one month’s rent in advance, one month as the deposit, and at most two months as an extra guarantee. That is the legal ceiling in Catalonia. Anything above it is unlawful, whatever the advert says.
Does this apply to me
Yes, if you are renting a flat or a room in Barcelona as your home, and it applies whatever your immigration status is. A landlord has no right to ask what papers you hold in order to charge you more, and none of these rules depend on you having a NIE (Número de Identidad de Extranjero, the foreigner identification number). Room rentals are covered too: rooms let under a contract signed from 1 Jan 2026 fall under the rent cap, and from 14 Jul 2026 the deposit on a room contract must be lodged and registered like any other.
What it costs
| Payment | Amount / when | Notes |
|---|---|---|
| Deposit | one month’s rent | Paid in cash at signing. |
| Extra guarantee | up to two months’ rent | Optional; two months’ rent is the maximum. |
| Rent in advance | one month and no more | The council’s own wording is that the landlord may “under no circumstances” demand payment on account of more than one month’s rent. |
| Estate-agency fees | €0 | The cost of managing the property and drawing up the contract is the landlord’s; charging it to the tenant is a very serious infringement carrying a fine of €90,001 to €900,000. |
| TPO rental tax | within one month of signing | The tenant files it with the Catalan Tax Agency. A stable and permanent home lease under article 2 of the Ley de Arrendamientos Urbanos signed from 6 Mar 2019 is exempt from it. |
What to get, before you hand over any money
Five things, and you have a right to the first four.
- 1. The full written contract, with every clause and annex.
- 2. The reference-price report from the Sistema Estatal de Referència de Preus de Lloguer d’Habitatge, at serpavi.mivau.gob.es. For any contract signed from 26 Mar 2026 this report must be presented, under article 10.10 of Decret llei 3/2026 of 24 Mar 2026, and INCASÒL will not accept the deposit without it. It is also the document that shows you the price the reference index allows. This is the newest and most useful paper on the list, so ask for it by name.
- 3. The cèdula d’habitabilitat, the certificate that the home is legally fit to live in, and the energy efficiency certificate. You have a right to receive both at signing.
- 4. A written, itemised receipt for every payment. If the landlord does not give you a receipt, any cost you run up proving that you paid is the landlord’s, not yours.
- 5. The landlord’s or agent’s name and identity document, and proof that they own or manage the property.
Where to go, and how to book
Free advice on a contract or an offer is at any Oficina de l’Habitatge, the council’s Housing Office network — one in each district. The general information and advice appointment is booked online or by calling 010, which is free from within the Barcelona metropolitan area. To see the legal adviser, though, you must request that appointment in person at any Housing Office; it cannot be booked by phone. For a problem with an agency rather than a landlord, the Oficina Municipal d’Informació al Consumidor is at Ronda de Sant Pau 43-45 in the Eixample, phone 010.
How long it takes
Booking the general Housing Office appointment takes minutes; the legal appointment costs you one trip to the office to request it. Checking your deposit is slower than it looks: INCASÒL states an approximate response time of two months on a deposit enquiry, so start it early rather than the week you move out.
What happens next
Your landlord must lodge your deposit with INCASÒL, the Catalan land institute that holds every rental deposit in Catalonia, within two months of signing — that is article 3 of Llei 13/1996. You can check they did it. Ask INCASÒL for a Certificat Informatiu de la fiança by writing to fiances.ingressos at gencat.cat (where this guide writes “at”, type the at-sign). For a refund that has not arrived, the mailbox is fiances.devolucions at gencat.cat. At the end of the tenancy the landlord must return the deposit. If a month passes after you hand back the keys and it has not been returned, you can demand it plus the legal interest on the money.
Mobile and internet, when you set the flat up
Switching provider and keeping your number takes one working day by law. You can cancel any mobile or internet contract at any time with two working days’ notice, even inside a minimum term: a minimum term cannot stop you leaving, it only means you may have to repay the discount you were given. If you cancel by phone the operator must give you a reference number, so write it down. A price rise must be notified to you one month in advance. To complain, complain to the operator first; if there is no answer within one month you have three months to take it to the state telecoms user office, the Oficina de Atención al Usuario de Telecomunicaciones, which then has six months to decide.
What goes wrong
Four things, and all four are common.
- 1. Never send money for a room or flat you have not physically seen, to a person you have not met, for a property nobody will show you. “I am abroad, send the deposit and I will post the keys” is a scam every time. There is no honest reason to need your money before you have stood in the room.
- 2. If an agency asks you for a fee, it is breaking the law. Do not pay it. Say so, and report it.
- 3. Do not accept “six months up front” or “a year up front”. The legal maximum in advance is one month.
- 4. Barcelona has been a declared stressed-market area since 16 Mar 2024, so the rent itself is capped by law and a new home lease here cannot be priced freely. The advert must state the price under the reference index, the previous contract’s rent, and whether the owner is a large landlord; omitting that is a serious infringement carrying a fine of €9,001 to €90,000. If the rent looks wrong, check it on the Ministry’s calculator at mivau.gob.es and complain — a rent set more than 30% above the maximum allowed is a very serious infringement, €90,001 to €900,000.
